Elyria – An Elyria girl was hit with multiple charges on Christmas after she sent her boyfriend to the hospital.

Police say that 20 year old Ashley Simmons of Elyria said she and her boyfriend, 24 year old Dustin Detamore of Elyria, had been arguing earlier in the evening. Simmons said she was trying to catch up to Detamore so she could speak to him. When Simmons crossed the railroad tracks on Olive, heading south, she said she could not stop her car and slammed into the back of Detamore’s car. Simmons told Police it was simply an accident and her actions were not intentional.

When Police and EMS arrived they found Detamore lying on the ground just outside of his vehicle.

LifeCare Paramedics treated Detamore at the scene before transporting him to Elyria Memorial with head and neck pains.

Police detected an odor of alcohol on Simmons who admitted to having a couple of beers earlier in the evening. After failing a number of field sobriety tests she was taken to the Police station where a blood alcohol test revealed her level to be a .144%. Being under 21 years old the legal limit would be .002%.

Simmons was charged with Underage Consumption (M1), OVI (M1), BAC (M1), Possession of Drug Paraphernalia (M4), Assured Cleared Distance Ahead (MM) and Expired Plates (MM).
