TAKING ON CITY HALL

COMMITTEE VOWS TO RECALL MAYOR
Elyria – A group of Elyrian’s upset at the direction their city is heading has had enough and Debbie Coon said they plan to do something about it. “We have formed “Citizens against Grace” and we will be working to recall Mayor Grace beginning the first week of July.” Coon said that the recall has been on the minds of people for some time, but recently they came into possession of a court document that, to them, was the final straw.

“This document is a lawsuit filed by Honey Rothschild against Mayor Grace and Elyria Law Director Pete Shilling for Retaliation, Breach of Contract, Sex and Racial Discrimination in Employment and Sexual Harassment. In it she alleged that Director Shilling Discriminated against her by advancing white employees before her even though she had more time in the office and had never received a bad review at work. It also says that Director Shilling subjected Rothschild and other female co-workers to intimidation.” (Count 34 Page 17; “The plaintiff and her other female co-workers have been subjected to intimidation, shouting, name calling like “fucking females” on the part of Defendant Shilling, their supervisor and the male co-workers who were allowed to yell, shout, embarrass and intimidate the female co-workers at all times including staff meetings.)

According to court documents, Rothschild sued Shilling in July of 2000 for Racial Discrimination and Sexual Harassment. That case was settled in January of 2002 with Rothschild receiving $25,000.00 and her lawyer receiving $15,000.00. Under that agreement Rothschild kept her job and agreed to not discuss the terms of the settlement. Rothschild filed another suit in 2003 after she alleged that Shilling breached the settlement agreement by retaliating against her, and continued to sexually harass her.

The 43 Count lawsuit, filed in Lorain County Common Pleas Court in September of 2003 and heard by Judge Edward Zaleski, said that Rothschild “brought her allegations of unlawful acts on the part of the Law Director to the attention of the City’s EEO Officer in December 1999, Mayor Grace refused to investigate as required by law and failed to perform his duties and responsibilities as the chief executive officer of the City of Elyria.” Coon said that is simply unacceptable and that Mayor Grace failed in his duties. “She took this to Mayor Grace and he essentially shoved it to the side and did nothing about it. I believe that Mayor Grace should have, because the complaint was against the Law Director, requested someone from the outside to come in and investigate the claims. This proves that our Mayor does not like people from the outside knowing what happens in his administration, he doesn’t like having to answer to the people of Elyria.”

Pam Jantzen, another committee member, said she was disgusted after reading the court document.
“As a woman I was very disturbed that something like this happened in our community and that our Mayor would not do anything to help her. She clearly turned to him for help on a couple different occasions and he turned her away and sent her back to Mr. Shilling.”

Jantzen points to Counts 6, 39 & 40 as the most disturbing to her. (Count 6 Page 8; “the Defendant Shilling, Law Director of the City of Elyria, in retaliation for filing sexual harassment charges against him, sent Plaintiff a, memo containing pornographic materials meant to shock and disgust her under the pretext of giving her an assignment to review criminal laws during a time when she was assigned to do civil work; Mr. Shilling tricked Plaintiff into reading the first part of the said pornographic materials; which includes vulgar references to female and male genitals and description of sex acts that disgusted and shocked Plaintiff and caused her anguish and humiliation.”


Count 39 Page 18 & 19; “That her co-workers have complained to Plaintiff about Defendant Shilling’s unwanted sexual advances, including but not limited to, touching them, kissing them, asking them their sexual preferences.”

Count 40 Page 19; “That her co-workers have complained to Plaintiff that they have had to shorten their work hours to avoid contact with Mr. Shilling, their supervisor, and at times have to avoid going to off site seminars and bar association conventions for fear that the Law Director will make unwanted sexual advances toward them during these trips.”

“Women and African-American’s in this community should be outraged by what happened in that office and the fact that our Mayor did nothing to help this woman, to me is appalling.”

Coon said in any Government agency you must operate in the open and talk to the people you serve.
“He doesn’t like his business to be out in the open, but when you are in a position as he is in, and there are documents out there like this one, you can try to hide them but someone will find them. You can hide whatever you want but just because you are Bill Grace doesn’t mean that you are untouchable.”

The committee is also upset over the actions taken by Mayor Grace concerning the Elyria Fire Department. Jantzen said some of the committee members live in District 2 and fear that with the closing of Station 2 their homes and lives may be at risk. “His (the Mayor) feeling is that even with only 14 guys on, instead of the 17, that the city and District 2 is still very safe and we all know that is not true. He has told me that where I live Station 1 is just as close to my house as 2’s but I know that is not right. I have had to use the Fire Department and although they did a great job it did take longer for them to get there because they came from downtown instead of E. Broad Street.”

The committee will have to wait until the first week of July to officially begin their recall efforts. By law they must wait 6 months from the time the person they want to recall is sworn into office. The committee will have to secure 20% of the number of people who voted for Mayor in the last election, which would be approximately 1,600 names. Once they have the names certified by the Board of Elections Coon said they would have to present it to the Elyria City Council and they would have to accept it. “If they accept it then the Mayor would have 5 days to either resign or chose to fight the recall and a special recall vote would be scheduled.”

In a sit down interview on Friday, TMCNEWS.NET informed Mayor Grace of the recall committee’s intentions and although he said it was unfortunate that they would feel the need to do something like this, he will continue working hard on moving the city of Elyria forward. “It’s frustrating because I know and the people around me know how hard I work and the team around me work – and all things considered I believe that we are doing an absolute exceptional job for the city given all the circumstances that are largely outside of our control. So it’s frustrating when people don’t agree or understand that and I certainly appreciate and understand and know that people make their judgment based on far less then all the information and it’s not even fair or practical for them to understand things at the depth that many of us do.”

The hot button topic recently has been the seemingly never-ending battle between City Hall and the Elyria Fire Department. In response to those who say it is Mayor Graces’s fault that Station 2 has been closed since the lowering of the Fire Departments minimum manpower back in August, the Mayor said that is an action of the Chief. “I’ve not been quick to distance myself from the charge that I closed the Station, I don’t run away from that because it’s a likely consequence of lowering staffing from 17 to 14, so I don’t shy away from that but that is an action of the Chief.”

When it comes to the question of response times in Station Two’s district Mayor Grace said that the effect has been minor in impact and helpful in revenue. “Those Stations (Cedar Street & E Broad Street) are only 50 seconds apart in transportation and there are portions of District Two that are just as close to Cedar Street as it is to Kipling.” The Mayor cited one of his more outspoken critics who lives on Pinewood in District Two. “Cedar Street Station is just as close to her home as the Kipling Street Station cause they both have to get to E. River and then travel south and E. River is right in the middle of those two stations. So anywhere along E. River south to Robin Park and that area off of Chestnut Ridge, the quickest way to get there from anywhere along Broad Street is to go down E. River and Cedar Street is just as close.”

In reference to the court document and the charges made by the committee that Mayor Grace should have done something about Director Shilling, the Mayor said that is out of his jurisdiction. “The Law Director is a separately elected official in the city and the employee in question is an “at will” employee of the Law Director – I don’t have jurisdiction over it or those individuals.”

When asked who would have jurisdiction over the Law Director and his office, Mayor Grace suggested perhaps City Council. “It’s such a rare thing, it would be City Council if anything and even that would be ceremonially – there’s no real mechanism there.”

Because of this particular case the city took a look at their sexual harassment policies.
“This event got us to take a look at our policies and procedures and lack of them in some cases – so there wasn’t such a policy in place and we put one in. It’s not just sexual harassment, it covers a wide spectrum of things that people feel they are being unfairly treated.”

Mayor Grace said that if a case were to come before him, of any type of harassment, he would treat it seriously and take the appropriate actions.

Coon said that the committee would continue working towards the recall. “We have a lot of work ahead of us, we know that and if anyone wants to participate or if they have any questions about the recall they can Email me @ debb_coon@yahoo.com.

I believe this story and the environment of Elyria workers because I was cheated out of a job with Elyria Police.

Even though my test scores were near the top of the eligibility list, Elyria Police managed to bypass me (and the other top scorers) and hired a police relative that was way down on the eligibility list.

Another applicant that I knew, knew the person that was hired. He verified that the person hired was in fact a policeman's relative.

And I can still recall my oral interview. As I sat at the end of a table with three police commanders and three fire department commanders, I was pelted with question after question. The police commander kept trying to break me and get me mad and fly off the handle. I didn't--I stayed calm and cool-headed. Since they couldn't find a reason to disqualify me, I wonder what criteria they used to disqualify me.

And why does the fire department sit in on police job interviews anyway? Is that really necessary?

some people will do anything to get their way. Grace said it, its the chief who closed station 2 not him. The same chief who is out on "sick" leave and will not retire.
Do these 2 realize it will cost the city money for a recall election? Maybe the 4th ward council person can figure out where that money is going to come from.

My bet is, they will get their signatures and Grace will win anyways and it will do nothing but get 2 cook jobs press time and cost money.

By the way, your story on the lawsuit is very informative.

hey anonymous, just so you know, when you take a civil service test, they can pick who they want from the top 3 or 5. Does not matter if you have the highest score. Most often they choose the highest but they are not obligated to do so. There are many factors they take into consideration. I wouldn't take it personal,and you sure don't want to burn bridges. You could still be hired if another opening comes available. Depending on the department those lists last for at least a year, maybe two.

Just goes to show how corrupt the legal system in Lorain County is, especially Elyria. Someone needs to come in and do an investigation on every department. (If they did there wouldn't be any department employees left!) If any city employee sticks up for this horrible mayor or law director it's because they have done their own dirt or because they're brain-washed into thinking this is normal!

When talking about EFD response times the mayor is misleading because he is changing the fire districts. Instead of comparing the response times betwen stations 1 & 2, he should be looking at how long it takes to get a fire engine to LCCC when engine 4 is busy on Chestnut Ridge(which used to be district 2 and is now covered by district 4 from North Abbe). Regardless of what Grace says, you are NOT well protected and the citizens on the north end of the city should be screaming their heads off!!

I see these two 'ladies' at the council meetings frequently. They only come to meetings to bring up the fire department issues. I never see anyone else with them that is on their 'side'. It is always just these two. They can't seem to get it through their skulls that the chief closed the station, not the mayor. And just because there is a pending lawsuit does not mean the information listed in the lawsuit is factual or true. They are wasting their time and the cities time on this recall. It won't go anywhere. Just because they disagree with the mayors decisions does not mean he needs recalled. He is merely doing his job.

Good job TMC on beating everyone to the story.
Too bad there is a negative spin on their campaign (Citizens Against Grace) rather than a positive (Citizens for a Better Elyria) one. May want to re-think that and see if it doesn't gather more people behind it.
Also, isn't this the same Rothschild who bought a property at the sheriff's auction a few years ago, then found out she couldn't get the property rezoned and was allowed to renig on her bid? Seems like she knows how to work the system. A $40k settlement that comes from our tax dollars, way to go judge!

If this was your daughter, mother, or sister who was sexually harassed or discriminated against would the mayor "JUST BE DOING HIS JOB" then? My guess, probably not. By the way, the lawsuit isn't pending. It's over and now there's a new lawsuit opened because the law director didn't follow the agreement of the first lawsuit. If it quacks like a duck and walks like a duck....It must be a duck!

The Fire Dept. is a very important part of any city, but he continues to put it down and tries to make out that we don't need them. What an insane assum -ption!! Please Elyria, Get this man out of the office he has trashed!!

Wake up and smell the odor coming from city hall. It reeks with over crowding in the directors offices,political cronies being hired for their support of the mayor and an arrogance that finds a deaf ear to the concern of the fine people of Elyria. Graceland belongs in Tenn. not Ohio. Any one who thinks that the design reviews with fancy,expensive brick brings buisness is mistaken. No need for the mayor to have a enclosed city pool, he's drowning in his own slime. This mayor has never accepted responsibility for any or all of his shortcomings, it's easier to blame everyone else. Thank-you to the ladies and their committee for bringing to light just one more reason to say Elyrians want their city back. We are proud,intelligent people that want to make the city of Elyria a place people want to live and not be from.

Wow the "ladies" are at it hot and heavy. Based on their reactions here they have no credibilty with me and I dont like Grace either, but in this they are so wrong and vindictive. They are petty people with a personal vendetta getting fed by 1 council person which if its true and I have been told it is, then he is a shameful person.

When this gets soundly defeated will thye wait 6 more months and try again and waste tax payer money?

I can’t believe at 6:13 pm the Chronicle or Journal has nothing as of yet on this story and TMCnews broke it yesterday if I am not mistaking mid day.

You’re going to want to look out for the PC police ladies. Look out for those who are going try to damage your reputation or make you look like trouble makers.Their going to try all kinds damage control in trying to save face or Mayor Graces’s job in the next few weeks.

People keep in mind this was all alleged,not proven.I can file a lawsuit and allege I invented the internet. I also notice that every coworker is unnamed and nobody joined her as an additional plaintiff and nobody else filed a lawsuit.Why didn't she take this all the way to a jury trail? Could it be it was filed just to get a settlement, knowing most insurance carriers will offer a cash settlement just to make it go away. I would like to go on but I have to go there's a lawfirm running a commercial right now urging me to pick up the phone and call them so we can sue somebody$$$$$

WOW!!! ladies you better run for them thare hills if you know what is good for you because they have a Law Firm wanting form them to pick up the phone to sue somebody $$$$$ that is 5 dollars ….must be one of those Ambulance Chaser Type Law firms who sues anyone any time any where even if there isn’t a chance to win the case.

Gee can you sue over a threat like the person just did on here to these ladies? Why did she drop the law suit hhhhhhhhhhhmmmmmmm was she threatened in some way shape or form?

Why wasn’t all this published in the news papers even though they say it was dropped? Was there a cover up? If there was a cover up well now one would think it is grounds for a Recall of Mayor Grace and Mr. Shilling to resign as well as all who helped in same cover up.

I see the ladies are not here after the meeting. I waited to see what they had to say after they got sucker punched by the Law Director. There whole story and reputation, what little they had, was shot down, BIG TIME.

TMCNEWS, I appreciate your efforts to produce good news stories, but this one here you way jumped the gun.

These 2 are going after the Mayor with a lawsuit that was removed by the person who filed it1
No credibility, no nothing. GONE. These two should crawl back under the rock. By the way, the EFD doesnt want you speaking on their behalf, you ruin it for them.

After seeing the performance of these so-called ladies last night, I know that several people will not be supporting their efforts.

In my opinion, they showed their true colors by cursing during their "speech" last night, where they could have showed a small amount of class and refrained from using the "F" word.

In addition, I am appalled that TMC NEWS would print that word, as now I need to monitor what my children and students read for news.

First of all;

Schilling denied any money was ever paid out to the women; then why would there be a settlement document that has his signature and hers as well acknowledging such?

These women are doing what they believe is right, and I can assure you they didn't use any language that isn't in the lawsuit itself..before you judge, make sure you get to read the document first..

As far as her saying the f word..I'm sure the law director was saying some fine words that you couldn't make out up there in his box..you just weren't sitting close enough.

I myself attended last night’s 7:00 pm City Council meeting and found it to very interesting in deed. I wanted to see for myself the reaction of Mayor Grace, Pete Shilling as well as counsel members would be when Debby Coon and Pam Jantzen presented finings and their intent to recall Mayor Grace. Now Mr. Shilling sounded out of control and bit worried if you ask me.

Now Steve M. if you were there then you know most of the people were there came to see an award given to the Elyria Basketball Couch and Team. It is unfortunate that more didn’t come for the fireworks and as far as the F word it is on the legal court document in its entirely, and why shouldn’t TMCnews print it are you within the PC Police.

If your hanging your hat on Ms. Rothschild, little do you know how horrible an attorney she is. She's now got the Law Director under her thumb because of the "Lawsuit"...and if anyone who works with her had a vote she would have been fired a long time ago. Having known and worked Judge Howard, I'm sure he's rolling over numerous times in his grave over his childrens actions. As others have said, just because it's in a lawsuit, that doesn't mean it's true or correct. Settling a lawsuit in this day, seems to make everything in a lawsuit true to lay people. Little do they know that most are settled due to the costly legal battles that ensue from them. If this is the biggest stick(Rothschild) that your going to start your story with, you should have picked a better stick. In a final note, I've never supported Mayor Grace and have only voted for him due to there being no better choice. Granted that the red brick and painted guardrails, have been some poor ideas, at least he's made minor attempts at improving the city.

I think the point of the matter is being over shadowed. Over shadowed from folks who are trying their best to perform damage control and trying to make people think or assume what ever is going on is about Honey Rothschild and her reputation as a lawyer or employee. Not the case!!

Let’s get back to the point and that is there seems to be a possible cover up issue at hand and Honey Rothschild is only named on the documents. I for one can not find on ether Lorain County Court web sites as well as the Elyria City Court records site. Why that is is the question?

These two Gals some might say have opened a can of worms and when ever it is opened all the way there might just be some big fish caught only time will tell. So until then I think we all should just step back and watch the lure’s work for now and see what is caught.

What surprised me at last night's council meeting is how disruptive Pete Shilling was when the two ladies were presenting to council. He basically proved their point for them by his yelling out. What didn't surprise me was how no one told him to be quiet until after the presenters were finished. The council president should have spoken up and told him to be quiet. It was another disgraceful display of the ineptitude of the current council president. As things come out, the question will be which council memebers knew what was going on and chose to do nothing or were they just too stupid to realize what was actually happening?

Since we are taking a look at old court records I decided to take a peek at the court records for Honey Rothschild.
It turns out that Ms. Rothschild thinks she deserves special treatment. What’s the matter Honey? Are you so special that you can park in handicapped zones?
Trust me I don’t have a problem with people getting parking tickets, I bet even TMC News gets those, but dear entitled Honey apparently has a penchant for parking handicapped zones. That’s lame Honey…very lame.
Then looking at the county court records we find Ms Rothschild is a victim of domestic violence… but wait, is she?
The court record speaks for itself:
“UPON CONSIDERATION OF THE EVIDENCE PRESENTED, THE COURT FINDS NO CREDIBLE EVIDENCE OF DOMESTIC VIOLENCE. REQUEST FOR CPO IS DENIED. ALL R/O'S ARE DISSOLVED AND SET ASIDE. COSTS TO PETITIONER. (MAGISTRTE ORDER) (TRB) (DAB) CC: PEITIONER, RESPONDENT, ATTY. WILLIS, SHERIFF VOLUME # 415 PAGE # 3924”

Then there was the time where Honey dodged service of a summons for over a year until the time period ran out and the plaintiff had to drop their suit against her. Impressive how a responsible party can just vanish. Well the fact is the process server did hand deliver a summons, but 10 days later it was returned to the court by a party who claimed they were not Honey….Hmmmm I hate when that happens.
Well Honey finally ran out of luck and places to hide and after NINE years paid the $10,000 she owed the plaintiff.
I wonder where the money came from…….
I could be all wrong but this is my understanding of the facts as I read them. I hate to have to put the usual comment about not being a supporter of the mayor, But, I’m not a fan of his. Call me apathetic.
I also don’t have an iron in the whole fire department fight so that puts me out of both issues. In fact the subject of the lawsuit and the man I am apparently defending by default is in my humble opinion, a jerk.
I just write this in the interest of fairness.
I don’t fault TMC for reporting the news, I don’t even fault the women who are leading this doomed to fail effort. I just get sick of hearing people throw out accusations that have weight.
Using allegations of sexual bias, sexual abuse are easy weapons these days. But using race as a weapon or a tool is despicable. I only hope someone related to a man as decent and noble as Judge Howard would not stoop to that. But, her court records are hers. I don’t think you would find similar behavior on the part of her father.

Well I was sitting behind the Players and the Coach and if they were laughing it look to me it was that Mr. Shilling got real loud and very forceful, I thought he was going to come out of his chair. Now that was very interesting to say the least, as far as the applause the Council President cut them off and when that happen Mr. Shilling pulled out a piece paper to read to every one on the case that was dropped.

Next……..

Now I am a long resident myself and there is something fishy. Why is it then if the case was dropped according to Mr. Shilling can’t those same Court Documents be found to be viewed by the public? Now the Gals have others showing that there was a settlement and those can’t be found on line as well.

First of all, I would like to apologize to TMCNEWS as I often forget that this is actually a blog, although it is utilized as a news source for Elyria since Elyria does not have one. (wink wink)

I still stand by my statement regarding the ladies using that language, as that is not very professional when you are attempting to present a very serious topic and accusation. Unfortunately, society uses that word in the same manner that most educated persons use a, an, and the.

RE: Shilling - I have never liked the way that he speaks to people, but he gets away with it. If my character was being attacked, I am sure that I would be on edge as well. I agree that the Council President should have taken control, but when has he ever taken control?

However, I still believe that these ladies need to learn restraint and to control their emotions when they speak at the mic. This isn't a rally... getting excited will only fluster you, not get others ramped up to help.

And it is very sad to see everyone leave after their acknowledgment. It could have been a GREAT civics lesson for EHS.

Once again, I apologize to TMCNEWS.

There are other employees at City Hall who have been victims of Pete Shilling's (I will not show him enough respect to call him MR.!) sexual harassement and outbursts of anger. Here is what people need to know...These victims need their jobs just like everyone else. It is not worth it to them to speak up and that is a sad situation to be in. (It's called "politics", you know, the same dirty little word that corrupts our government) As for Honey, she's not a "liked" person at City Hall, but give the women enough credit for standing up to this bully. It's time for Grace and Shilling to get the boot! Elyria is still a small enough city to have "cult-like" characteristics when it comes to ALL CITY DEPARTMENTS. If you stand out from the majority they will rip you apart. But, Elyria's crime and drug problems is that of a big city!

I have never been a fan of Moss’ since it made the move down to the center of town. However, I fully agree with Sandy and her position on not wanting any part of that meeting. As a business owner in this town and having had dealings with city people, not the Mayor himself but people under him. I would never stick my neck out like that. I assure you that if Sandy allowed that meeting to take place in her business she would begin experiencing all sorts of trouble. Don’t believe me, just ask The Bradys at Twist & Shake, Joe Monteleone at Master Pizza, the people at the new Olive Garden or the construction firm that built the new CCF building by WalMart. The list could go on and on. Businesses in this town struggle everyday to survive and the current administration does NOT make things any easier for us. We all know to keep our mouths shut or else. Sad but true.

Have you seen Mayor Graces Tank? He is driving a Ford SUV big and green it has to be a big gas guzzler.

Does anyone know if he gets his gas free through the city? If so that vehicle has to burn at least $100.00 or more a week depending where he drives.

Question…Why doesn’t Mayor Grace cut back on some of his perks he gets from the City to help the budget problem? He is asking us to dig deep to help the cause possibly in August this year.

First of all does anyone know the price that was paid to whom ever to conduct a phone survey about how everyone felt about City services? You know the one where everyone knew was going to be a flop.

Look folk’s bottom line here…We have no choice but to vote in a tax hike when the time comes for our sake, not because the Mayor and company says we need it no matter how the Mayor wants to word it on the ballot.

The word on the street is that the Mayor and his Administration has got this City in such a world of hurt it’s not funny. So We the People need to take the City back from Mayor Grace and his administration by a Recall vote.

So look at it this way folks by voting for the tax increase we would be giving the new Mayor him or her the tools to start making this City start growing again and making folks proud of their City again.

We should applaud Jim for letting a group of people have a meeting to discuses what every the want to discus because he knows this is a Free Country. It doesn’t matter what Jim’s feelings are on this recall issue, what matters is he will not be told who can and can’t meet in is Coffee Shop.

Today as you know is part of Memorial Day weekend, a day to remember those who have fallen as well as those who are still serving our Country today to keep us Safe and Free to live our lives as we choose.

So my hat is off to you Jim in expressing your right and freedom to let folks express their right and freedom to hold meetings of their choice in your Coffee Shop no matter whom or what is about.
