MEN ARRESTED WITH LOADED GUN
Elyria – Two Oberlin men were arrested early Sunday morning after Police were told one of them was waving a gun in the downtown Burger King Parking lot.
Police were called Sunday morning just before 3 a.m. and were told that a black male wearing a red jacket with an “R” on the back displayed a handgun in the Burger King parking lot. The witness told Police Dispatchers that the man had jumped into a dark blue Buick and headed south on West Ave.
Officers who had just finished with several large disturbances on Lake Ave near Uncle Vics responded and found the car with two subjects inside on West just south of 3rd Street. Officers attempted to stop the car but it continued and made an abrupt turn onto Earl Court near the Wesleyan Village. The car jumped a curb and entered a field where it came to a stop. Officers observed the passenger throw a black object, appearing to be a gun, over the hood of the car into the field.
Officers performed a felony style stop on the car and took both men into custody. One Officer located a Hi-Point Firearms Model C 9mm lying in the grass in the area where the Officer saw it thrown.

Police arrested Kibwe Brooks of Oberlin for Carrying a Concealed Weapon F5 and Having Weapons Under Disability F3. While transporting Brooks to the Police Station they discovered that he had six prior felony drug convictions along with several felony domestic violence, and assault convictions.
Police arrested Philip Shumate of Oberlin for Failure to Comply with Officer Signal / Order M1. Police report that while Shumate was leaving the booking area he started talking to Brooks and Brooks said to Shumate, “are you going to let me take all these charges?” Shumate then turned to Officers and said, “It was my gun.” But when Officers asked Shumate to write a statement and sign his Miranda rights, he refused to speak further with Officers.
While Brooks was being transported to the County Jail he told the Officer, “I can’t believe he’s making me take the charges and it is his gun. I’ll admit I through the gun out the window but that was his gun. I’ll admit in court I threw the gun but he was fighting with the Elyria dudes and he had the gun.” Police say that Shumate repeated over and over, “that was his gun, that was his gun. He asked me to throw it.”
